Traveling on H4 requires understanding the critical distinction between visa stamp validity and status validity. One common mistake, traveling with an expired H4 stamp, can leave you stranded abroad.
This is the single most misunderstood concept in H4 travel, and confusing it can strand you outside the US or cause re-entry denial. Understand this thoroughly before any international trip:
H4 Visa Stamp (in your passport)
H4 Status (your I-94 record)
Bottom line: You need a VALID visa stamp to RE-ENTER the US. If your H4 visa stamp is expired and you travel internationally, you cannot use CBP's automatic reentry, you must get a new H4 stamp at a US consulate before returning.
| Scenario | Can Depart? | Can Reenter? |
|---|---|---|
| Valid H4 visa stamp + H4 status valid | Yes | Yes |
| H4 visa stamp expired, H4 status still valid | Yes | No / Risky |
| Traveling during H4 EAD renewal pending | Yes | No / Risky |
| Principal on H1B extension (I-797 receipt only) | Yes | Yes |
| H4 COS pending (H4 to another status) | Yes | No / Risky |
| H4 status expired (out of status) | No | No / Risky |
CBP officers will verify your H4 eligibility at the port of entry. Having a complete, organized document packet prevents secondary inspection and delays. Here is everything to carry:
Valid H4 visa stamp
Must be unexpired at time of entry attempt. Check expiry in your passport.
Valid passport
At least 6 months validity beyond intended stay
H4 I-94 (print or recent)
Shows your authorized period of stay, print at cbp.dhs.gov/I94
Principal's I-94
Shows spouse's valid H1B status
Principal's I-797 approval notice
Most recent H1B approval, or extension approval
Marriage certificate
Proving relationship to H1B principal, certified translation if not in English
Proof of employment (principal's)
Offer letter, pay stubs, or employer letter confirming active H1B employment
H4 EAD card (if applicable)
Not required for entry, but helpful to show US authorization
If your H4 visa stamp is expired and you need to travel internationally, you must renew your H4 stamp at a US Embassy or Consulate. This can be done in your home country (India, for most H4 holders) or in a third country like Canada or Mexico. The process is the same regardless of location.
Book DS-160 appointment
Complete DS-160 nonimmigrant visa application online at ceac.state.gov. Select H4 as visa category.
Schedule consulate appointment
Book through the US Embassy in your country. Wait times vary, Mumbai/Chennai: 2β6 weeks; Delhi: 3β8 weeks; Third-country (Canada, Mexico): 1β3 days.
Gather documents
DS-160 confirmation, appointment letter, passport, H4 I-94, principal's I-797, I-140 (if applicable), marriage certificate, financial documents.
Attend visa interview
Consular officer will ask about relationship, principal's employment, and your plans in the US. Most H4 renewals are straightforward.
Visa issuance
Typically 3β5 business days after interview. Administrative processing (221g) can add weeks in some cases.
Find appointment availability and complete the DS-160 application at travel.state.gov visa appointment wait times.
Some H4 EAD holders assume that because they're authorized to work, traveling is safe even with an expired H4 stamp. This is incorrect. The H4 EAD (Form I-766) is a work authorization document only, it does not function as a travel document and cannot be used in place of a valid H4 visa stamp for re-entry.
Recommendation: Before any international travel, consult an immigration attorney and verify: (1) your H4 stamp is valid for re-entry, (2) no I-539 petition is pending, and (3) principal's H1B status is fully valid.
A common scenario: your spouse's H1B has been extended (new I-797) but the I-94 period on the original approval has expired. When you travel and return to the US on H4, CBP needs to see that the principal's H1B is still valid.
Carry original H1B I-797 (first approval)
Shows the original H1B was granted
Carry extension I-797 approval notice(s)
Shows each renewal and current validity period
If extension receipt only (no approval yet)
This is a gray area, CBP may not admit on pending extension. Consult attorney before travel.
Carry employer letter confirming H1B status
A letter from the principal's employer on letterhead confirming active H1B employment is very helpful
