How to Get a New H4 Visa Stamp at a US Consulate?

The H4 EAD (Form I-766) is a work authorization document only, it does not function as a travel document and cannot be used in place of a valid H4 visa stamp for re-entry.

  • H4 EAD does NOT provide travel authorization, it is a work document only
  • Departing the US while an I-539 (H4 extension) is pending automatically abandons that petition

A common scenario: your spouse's H1B has been extended (new I-797) but the I-94 period on the original approval has expired. When you travel and return to the US on H4, CBP needs to see that the principal's H1B is still valid.
