Specialty Occupation Proof for Software Engineers: The RFE Minefield

USCIS has issued RFEs on software engineer petitions arguing that "software developer" is too broad to establish that a bachelor's degree in a specific field is always required. A strong H-1B petition for SWE roles must include:

  • Specific technical duties: List specific technologies, programming languages, algorithms, and systems the role uses. "Write code" is insufficient.
  • Complexity level: Describe why the work requires a BS in CS specifically—not just generic engineering. Mention distributed systems, ML models, cryptography, or whatever advanced concepts apply.
  • Degree requirement justification: The employer should attest that they consistently hire only BS/MS graduates for this specific role and that the nature of the work precludes self-taught candidates.
  • Industry data: Include BLS data showing that software developer positions in your industry typically require a bachelor's degree.
