Employer Agrees to Refile PERM

Your employer must agree to file a new PERM labor certification for EB3. This takes 12–18 months (6+ months if audited). EB3 requires ≥BS degree or 2 years experience for most tech roles.

File New EB3 PERM

Employer files ETA-9089 with DOL under EB3 requirements. Same job duties as your current role must be supported. DOL processing: 6–14 months currently.

File EB3 I-140

After PERM approval, file I-140 with USCIS. Request portability of your original EB2 priority date on the I-140. Premium processing ($2,805) available.

File I-485 When EB3 Date Allows

Once I-140 is approved and the EB3 India Final Action Date is past your priority date, file I-485 (adjustment of status). This gives you EAD + Advance Parole.
