Chinese nationals face a different set of H1B challenges than India: Visa Mantis delays, moderately retrogressed EB2/EB3 dates, EB1 as the fast track, and security clearance restrictions.
China-born professionals face EB2 and EB3 retrogression, but at a much less severe level than India. EB2-China is currently around November 2017, advancing 5–10 months per year.
| Fiscal Year | EB2 China | EB3 China | EB1 China |
|---|---|---|---|
| FY2020 | Jun 2016 | Jan 2017 | Current |
| FY2021 | Nov 2016 | Jun 2017 | Current |
| FY2022 | Mar 2017 | Dec 2017 | Current |
| FY2023 | Jun 2017 | Apr 2018 | Current |
| FY2024 | Sep 2017 | Jun 2018 | Current |
| FY2025 | Nov 2017 | Aug 2018 | Current |
EB2-China advancing ~8–10 months per year on average. At this rate, a 2024 priority date would reach Current in approximately 7–9 years.
Visa Mantis is an interagency security review for H1B and other visa applicants working in "sensitive" technical fields. Under the Technology Alert List (TAL), certain STEM fields trigger mandatory security checks before a visa can be stamped. Chinese nationals in the following areas frequently receive Mantis holds:
Mantis holds add 60–90 days to consular processing, occasionally longer. To minimize risk: file for visa stamping at least 4–6 months before your planned travel date, provide complete employer documentation including end-client details, and consider third-country stamping (Hong Kong or Canada) which has historically processed faster.
The single best green card strategy for Chinese H1B holders is EB1, which currently has a Current Final Action Date — meaning no wait. If you file an EB1-A or EB1-B I-140 today and it's approved, you can file I-485 immediately.
Self-petition, no employer required, Current PD. Requires meeting 3 of 10 USCIS criteria showing "extraordinary ability" in your field. Chinese researchers with citations, patents, and peer review service are strong candidates.
Employer-sponsored, requires recognized international standing in academic research. Must show at least 2 qualifying criteria (prizes, publications, peer review, etc.) and have a job offer from a university or research company.
| Consulate | Appointment Wait | Notes |
|---|---|---|
| Beijing (US Embassy) | 4–8 months | Main consular post. STEM background checks can add 60–90 days (Visa Mantis). |
| Shanghai (US Consulate) | 3–6 months | Often faster than Beijing. Strong for tech sector applications. |
| Guangzhou (US Consulate) | 3–7 months | Serves South China. Processing similar to Shanghai. |
| Hong Kong (US Consulate) | 2–4 months | Often fastest option. Third-country stamping permitted for China-born applicants. |
| Canada (Calgary, Vancouver) | 4–8 weeks | Third-country stamping. Many Chinese H1B holders prefer Canada appointments to avoid Mantis delays. |
US security clearances (Secret, Top Secret, SCI) require a National Security Investigation that considers Foreign National ties. FOCI (Foreign Ownership, Control, or Influence) provisions effectively bar most Chinese nationals from obtaining clearances, regardless of US residency duration.
Commercial tech (Google, Amazon, Meta, Apple, Stripe), finance, healthcare, and academia are generally unaffected. The commercial tech sector recruits heavily from Chinese universities and has no clearance requirements for the vast majority of software engineering roles.
