H4 EAD eligibility for renewal is the same as for the initial application. You must meet at least one of the following two conditions — and your H4 status must remain valid throughout:
Condition 1: Approved I-140
Your H1B spouse must have an approved I-140 immigrant petition in any employment-based category (EB-1, EB-2, or EB-3). A pending I-140 or pending PERM alone does not qualify.
Condition 2: 7th Year H1B Extension
Your spouse is in H1B status beyond the 6-year limit — in a 3-year extension granted under AC-21 (8 USC § 1184(g)(4)). The underlying I-140 must have been filed at least 365 days ago.

The Trump administration's second term, which began in January 2025, has expressed policy interest in rescinding the H4 EAD rule established in 2015. H4 EAD holders should ensure their renewal packages are complete and include the most current I-797 and I-140 documentation.

USCIS does not offer premium processing for Form I-765. Current processing times vary by service center.
