When should F-1 students apply for H-1B?
Enter the lottery in March of your OPT year (ideally the first March you are eligible). You can enter up to 3 consecutive years. If selected, H-1B starts October 1. The cap-gap provision covers the period between OPT expiration and October 1 if your OPT expires between April 1 and September 30.
What happens if I cannot get H-1B during OPT?
Options: (1) Apply for STEM OPT extension (24 months) if eligible β gives 2 more lottery chances; (2) Return to school for another degree; (3) Find a cap-exempt employer (university, nonprofit research); (4) Change to H-4 if married to H-1B holder; (5) Leave the US. There is no grace period after OPT expires β plan ahead.
Can I start working before October 1 on H-1B?
No. H-1B start date is October 1 for new cap-subject petitions. If your OPT expires before October 1 and you are in the cap-gap, you are authorized to work on the cap-gap extension β but strictly until September 30.
Does STEM OPT require E-Verify?
Yes. STEM OPT employers must be enrolled in E-Verify. This is a hard requirement β working for a non-E-Verify employer on STEM OPT puts you in unauthorized status. Verify before accepting any offer.
