H-1B Cap-Gap 2026: Keep Working After OPT Expires While Waiting for October 1

H-1B selected in March. OPT expires in July. H-1B starts October 1. Cap-gap is what keeps you legal and employed for those 3 months. Here's the exact playbook.

How Cap-Gap Works: The Legal Framework

Cap-gap is codified in 8 CFR 214.2(f)(5)(vi). When an F-1 student is selected in the H-1B lottery and their employer timely files an H-1B change of status petition (Form I-129) requesting an October 1 start date, cap-gap provides two automatic extensions:

  • F-1 status extension: Your F-1 student status is extended through September 30, regardless of when your DS-2019 or I-20 program end date was.
  • OPT EAD extension: Your EAD work authorization is extended through September 30, even if your EAD card has already expired or shows an earlier expiration date.

This is not an application, it's automatic. You do not file any additional form with USCIS. However, you must get your DSO to issue an updated I-20 with cap-gap notation. This I-20, combined with your original EAD and the H-1B receipt notice, is your proof of authorized work and status during cap-gap.

The Three Cap-Gap Scenarios: Which Applies to You?

Scenario 1: OPT Is Still Valid When H-1B Is Filed

Your OPT EAD is still valid on April 1 (or whenever your employer files). Cap-gap automatically extends your EAD through September 30. Continue working normally. Update I-20 with DSO.

Scenario 2: OPT Expires Before October 1

Your EAD expires in June but your H-1B petition was already filed before expiration. Cap-gap kicks in, your work authorization continues through September 30 even though your EAD is 'expired.' The cap-gap period is what authorizes work, not the EAD card.

Scenario 3: H-1B Petition Withdrawn or Denied Mid-Cap-Gap

If your employer withdraws the petition or USCIS denies it during cap-gap, cap-gap ends immediately. You have 60 days to leave, change status, or take action. Stop working the same day.

Travel During Cap-Gap: Why You Should Stay in the US?

This is where students make costly mistakes. Cap-gap is a status protection, it keeps you in legal status inside the US. It does not give you a travel document or the ability to return to the US from abroad.

If you leave the US during cap-gap, you cannot re-enter on your OPT EAD or F-1 status, cap-gap status does not exist outside US borders. To re-enter, you need an H-1B visa stamp, which you'd have to get at a US consulate abroad. But you may not yet have an approval notice (just a receipt) if USCIS is still processing. And consular appointments can take weeks or months.

The practical risk: you travel for a wedding in India in August, you're abroad during cap-gap, your H-1B is still pending, and you can't get a consular appointment until November. You're stuck. Don't travel during cap-gap unless you have an H-1B visa stamp already in your passport.

What Your DSO Needs to Do for Cap-Gap?

  1. Issue an updated I-20: The I-20 must reflect your cap-gap extension with a remark noting the cap-gap dates and your H-1B petition receipt number. Request this as soon as you receive the I-129 receipt notice from your employer.
  2. Update SEVIS: Your DSO must update your SEVIS record to reflect the cap-gap extension. Without the SEVIS update, the I-20 may not work properly with employers' electronic I-9 verification systems.
  3. Issue new I-20 if petition is denied: If your H-1B is denied, your DSO must update SEVIS again to reflect that cap-gap has ended. This is critical for accurate tracking.

I-9 Verification During Cap-Gap: What to Show Employers?

For I-9 verification during cap-gap, present the following combination:

  • Your OPT EAD card (even if the printed expiration date has passed)
  • Your updated I-20 with cap-gap notation
  • H-1B I-129 receipt notice (Form I-797C)
