Every H-1B petition starts with a DOL Labor Condition Application (LCA), which the employer files before the case ever reaches USCIS. Among employers with 1,000+ LCA filings, certification rates range from 100% down to 22.4%, a real, DOL-verified spread, not an estimate. Below are the actual highest- and lowest-rate sponsors from the disclosure data.
What This Data Actually Measures
The rate below is the DOL LCA certification rate, certified filings divided by (certified + denied), based on Department of Labor disclosure data. This is not the same as the final USCIS I-129 petition approval rate. LCA certification is an earlier, largely procedural DOL step; USCIS adjudication of the actual H-1B petition (specialty occupation, wage level, employer-employee relationship) happens afterward and isn't captured in this dataset. Treat this as a signal about an employer's LCA filing quality and consistency, not a guarantee of final visa approval.
Highest LCA Certification Rates Among Major Sponsors
Filtered to employers with ≥5,000 total LCA filings (DOL FY2022–2026), so the list surfaces large, recognizable sponsors rather than smaller filers that happen to sit at 100% on thin volume.

Lowest LCA Certification Rates (≥1,000 Filings)
The lowest rates in the real data are not dominated by IT staffing or outsourcing firms , several of the largest outsourcing sponsors (TCS, Wipro, Cognizant, Infosys) actually post certification rates above 97%, higher than many well-known direct-hire employers. The genuine low-rate cluster here is a mix of one notable outlier and several research universities.

What the Real Data Shows, and Doesn't
Large IT services firms are not the low performers
TCS (99.3%), Wipro (98.2%), Cognizant (97.7%), and Infosys (99.6%) all certify at rates comparable to or higher than many direct-hire tech employers. A common assumption, that major outsourcing sponsors have worse LCA outcomes, doesn't hold up against the DOL disclosure data.
Research universities cluster at lower rates
Johns Hopkins, Harvard, Yale, Emory, and several public university systems all sit between 57% and 70% certification. The data doesn't tell us why, it could reflect how research and postdoctoral roles get filed, wage-level determinations for academic titles, or other LCA-specific factors. This is a pattern worth knowing, not a proven cause.
One employer is a clear outlier
TekOrg Inc. certifies at 22.4% on 2,300+ filings, dramatically below every other employer in this dataset at similar volume. That's a real, verifiable data point from DOL disclosure records, not an estimate.
This is a filing-quality signal, not a lottery or visa guarantee
A high LCA certification rate says an employer's DOL filings are consistently well-prepared. It says nothing about USCIS I-129 approval, RFE rates, or your individual odds in the H-1B lottery, those are separate processes this dataset doesn't cover.
What This Means for Your Job Search
- Don't assume outsourcing firms file worse LCAs. The real data shows major IT services sponsors (TCS, Wipro, Cognizant, Infosys) certifying above 97%, on par with or better than many household-name direct-hire employers.
- Check the employer's own LCA filing history, not just brand reputation, before assuming their visa process will be smooth. This page and the DOL disclosure database are both public and searchable.
- Remember this measures LCA certification, not final visa approval. A 100% LCA certification rate doesn't change your USCIS I-129 adjudication odds or your H-1B lottery odds, those depend on separate factors.
