H-1B Portability Under AC21: How to Change Jobs Without Losing Your Status

What AC21 Portability Means
The American Competitiveness in the 21st Century Act (AC21), enacted in 2000, created H-1B portability. It allows H-1B workers to change employers without waiting for USCIS to approve the new petition, as long as specific conditions are met.
You must have been in valid H-1B status for at least 180 days continuously
Your new employer must file an H-1B transfer petition on your behalf
Once the transfer is filed, you can start working for the new employer immediately
USCIS approval of the transfer petition later validates your continuous lawful status
The 180-Day Requirement: What It Actually Means
The 180 days refers to the period you must have been in valid H-1B status, not the length of time with your current employer. It starts from the date your H-1B status was approved, the status start date on your I-797.
Day 1 starts on your H-1B status start date, typically October 1 for cap-subject H-1Bs
Days count continuously, periods of travel outside the U.S. generally do not interrupt the count
If you change employers before 180 days, you must wait for USCIS to approve the transfer before starting
After 180 days, you can start immediately upon filing and do not need to wait for approval
Same or Similar Occupation Requirement
H-1B portability requires the new position to be in the same or similar occupational classification as the original H-1B petition, evaluated under the Standard Occupational Classification (SOC) system.
Same occupation: identical SOC code, clear-cut portability
Similar occupation: overlapping duties, skills, and industry, evaluated case by case
A software engineer moving to machine learning engineering: likely similar occupation
A software engineer moving to a product manager role: potentially different classification, get legal advice
Document the job duties of both positions to support a portability argument if challenged
Green Card Portability Under AC21
AC21 portability extends to pending I-485 applications. If your I-485 has been pending for at least 180 days, you can change employers or change to a similar job without affecting your pending green card application.
The underlying I-140 must have been approved at the time you invoke portability
The new job must be in the same or similar occupational classification as the job on the original I-140
File Form I-485J (Supplement J) to formally invoke portability and connect the new offer to the pending I-485
Your original priority date from the I-140 is preserved, you do not lose your place in line
