Biotech companies like Genentech, Regeneron, or Moderna, and pharmaceutical companies like Pfizer and Merck, are cap-subject employers that require lottery participation.

This creates an important strategic consideration for international biomedical PhD graduates: a position at a cap-exempt academic institution can secure H-1B status without lottery risk, while industry positions require competing in the lottery. Many international biomedical scientists deliberately begin their US careers in academia, postdocs, research scientist positions, specifically to secure H-1B status before transitioning to industry.

Once you have an approved H-1B from a cap-exempt employer, you can transfer to any employer including for-profit biotech and pharma companies without re-entering the lottery. This makes academic H-1B sponsorship a strategic stepping stone for scientists who ultimately want industry careers but need secure work authorization first.

Postdoc to Research Scientist: The Immigration Timeline

Most international biomedical PhD students complete their training on F-1 student visas, then enter 1-2 year postdoctoral positions. Many postdocs are initially sponsored on J-1 Exchange Visitor visas, which are simple to obtain but carry a potential 2-year home residency requirement that can complicate long-term US career plans. H-1B for postdocs is increasingly preferred by researchers who plan to build long-term US careers.

Universities can file H-1B for postdoctoral researchers at any time (cap-exempt) with USCIS approval typically taking 3-6 months. For postdocs finishing F-1 OPT or STEM OPT, universities can file H-1B before OPT expires, maintaining continuous authorized work status. This is a critical planning consideration, OPT timing must be monitored carefully to ensure the H-1B petition is filed before OPT expiration.

Research Scientist positions (post-postdoc) are often permanent or long-term staff scientist roles at universities or research institutes. These positions warrant H-1B with full employer support of the H-1B process and often PERM/green card sponsorship. At this career stage, the employer's immigration support becomes a significant factor in career decisions, ask prospective employers directly about their track record of sponsoring researchers through the green card process.

Industry transitions typically happen after 1-3 postdoc experiences. A biomedical scientist who spent 3 years as a postdoc on H-1B at a university can transfer their H-1B to a biotech company in approximately 1-3 months. The biotech company files an H-1B transfer petition and the researcher can begin work as soon as USCIS receives the petition (portability), without waiting for approval. This seamless transition is one of the H-1B system's most employee-friendly features.

Salary Reality: Academia vs. Biotech on H-1B

The compensation gap between academic and industry biomedical science positions is substantial and widens with career seniority. For the immigration calculation specifically: biotech companies pay higher salaries but require either winning the lottery or having a prior H-1B. They also often move faster on PERM sponsorship for key scientists, though the priority date queue applies equally regardless of employer salary. Academic institutions provide cap-exempt access and the credential-building environment for EB-1A/NIW, which can leapfrog the backlog entirely.

Building Toward EB-1A: The Biomedical Research Strategy

EB-1A for biomedical scientists is achievable with a deliberate credential-building strategy over 5-8 years of productive research. USCIS adjudicates EB-1A petitions against 10 criteria, requiring the petitioner to meet at least 3. For biomedical researchers, the most accessible criteria are: original contributions of major significance in the field (high-impact publications), published material about the person and their work (press coverage, institutional features), authorship of scholarly articles in professional journals with international circulation, and participation as a judge of the work of others in the field (grant review, manuscript peer review).

High-impact publications are the foundation. Publishing in Nature, Science, Cell, and their family journals, or in field-leading journals like PNAS, Journal of Clinical Investigation, or Cancer Cell, provides the "original contributions of major significance" evidence. Citation counts matter: Google Scholar profiles showing significant citations to your work support the "contributions of major significance" criterion. Building a Google Scholar profile and maintaining it from the beginning of your research career is advisable.

Peer review activity generates evidence for the "judge of others" criterion. Register with journals in your field to become a reviewer. Review 10-15 manuscripts per year and keep a log. Similarly, apply to review NIH study sections, even ad hoc reviewer roles count. These activities are routine scientific citizenship but generate concrete documentary evidence for EB-1A applications.

Awards, fellowships, and grants in your own name, not just your PI's grants, support the "lesser nationally or internationally recognized prizes or awards for excellence" criterion. NIH F32, K99/R00, NSF CAREER, and private foundation fellowships are particularly valuable. Present at major international conferences in your field. Get invited to give seminars at other institutions. Join organizing committees for scientific meetings. These activities build the recognition profile that distinguishes an EB-1A-worthy researcher from a productive but ordinary scientist.

Navigating Lab Changes and PI Conflicts on H-1B

One of the most stressful situations for international biomedical researchers is a laboratory conflict requiring a PI change. If your H-1B is sponsored by a specific university department or lab, and you need to change labs, whether due to funding loss, PI departure, scientific conflict, or institutional closure, your H-1B authorization must transfer to the new sponsor before you can continue working.

Within the same university, lab changes typically require filing an amended H-1B petition rather than a full transfer, as the employer remains the same institution. Process this through the International Scholar Services office as soon as a lab change is contemplated, do not begin working in the new lab until the amended petition is filed, as working without authorization is a serious status violation even within the same institution.

Moving between institutions requires a full H-1B transfer petition from the new employer. Under H-1B portability, you can begin working at the new institution as soon as USCIS receives (not approves) the transfer petition, provided the new petition is nonfrivolous and you are in valid H-1B status. This portability provision is critical, there is no mandatory gap between employment at the old and new institution.

Funding gaps are a particular risk for grant-funded research positions. If an NIH grant ends and the PI cannot obtain new funding, the research position may be eliminated before the researcher finds a new position. H-1B workers in this situation have a 60-day grace period after position loss to find a new employer and have an H-1B transfer petition filed. This 60-day window is not extendable, and working without authorization after the grace period violates status. Begin job searching aggressively as soon as funding uncertainty arises, do not wait for the formal grant end date.
