Action Plan for Non-Selected Registrants

H1B Lottery Not Selected: 8 Actionable Paths Forward

Not being selected in the H1B lottery is not a visa denial, it is simply a random outcome that affects even highly qualified candidates. Here are eight concrete alternatives, each with eligibility requirements, realistic timelines, and cost estimates, so you can move forward immediately.

Key fact: In FY2026, 65% of all H1B registrations were not selected, even at a 35% selection rate, the majority of qualified candidates must pursue alternatives. You are far from alone.

What "Not Selected" Actually Means?

What it IS

  • A random non-selection in the numerical lottery
  • An expired registration, no further action needed
  • A common outcome (65% of FY2026 registrations not selected)
  • A starting point to explore alternatives

What it IS NOT

  • A visa denial, no denial exists on record
  • A reflection of your qualifications
  • Permanently disqualifying for future lotteries
  • Cause for immigration concern or status issues

The registration period expires, the $215 fee is forfeited, and your status in the US is completely unaffected by the non-selection. If you are on OPT, your OPT continues until its authorized end date. The clock starts ticking on the alternatives below as soon as you know the outcome.

H1B Cap-Gap: If You Were Selected (Not Rejected)

If you were selected in the lottery and a petition was filed on your behalf, and you are currently on OPT, you benefit from H1B cap-gap protection. This automatically extends your OPT work authorization through September 30 (or until your petition is adjudicated, whichever comes first), even if your OPT EAD would have expired earlier.

The cap-gap protection is based on your I-20 being properly extended with the cap-gap notation. Your Designated School Official (DSO) must update your SEVIS record to reflect the cap-gap period. If your petition is approved, your H1B status begins on October 1.

This section is only for people whose petition was filed and is pending. Non-selection does not create any cap-gap protection because no petition was filed.
