EB-3 Green Card: Complete 2026 Guide

EB-3 is one of the most widely used employment-based green card categories, but India and China face decade-long backlogs. Here's how to navigate it.

What Are the Three EB-3 Subcategories?

CategoryEducation RequiredCommon JobsPERM?
EB-3W (Skilled Workers)2+ years training or experienceIT technicians, machinists, tradespeopleYes
EB-3 ProfessionalsUS bachelor's degree or equivalentEngineers, accountants, architectsYes
EB-3U (Unskilled/Other Workers)Less than 2 years trainingHousekeepers, food workers, caregiversYes

All three EB-3 subcategories require PERM labor certification from DOL, the employer must prove no qualified US worker is available for the position. This process alone takes 8–18 months.

What Is the EB-3 Process from Start to Green Card?

1. PERM Labor Certification

8–18 months

Employer posts job ads, conducts recruitment, files ETA-9089 with DOL. Must prove no qualified US worker available.

2. I-140 Petition

6–8 months standard / 15 days premium

After PERM approval, employer files I-140 with USCIS to classify you in EB-3. Premium processing available ($2,805).

3. Wait for Priority Date

Varies by country, see Visa Bulletin

India EB-3: currently 10+ year backlog. China EB-3: 5–8 year backlog. ROW (Rest of World): often current.

4. I-485 Adjustment of Status or Consular Processing

12–24 months after PD becomes current

File I-485 when priority date is current (in the US) or attend immigrant visa interview abroad.

What Is the EB-2 to EB-3 Downgrade Strategy?

Indian nationals with approved EB-2 I-140s sometimes file a second I-140 under EB-3 to "downgrade", not because EB-3 is better, but because India's EB-3 priority date has occasionally moved ahead of EB-2 in the Visa Bulletin. This strategy is called "porting", it preserves the earlier priority date from EB-2 while using EB-3's current date advantage.

The downgrade requires a new PERM or a self-petition justification (if no PERM is needed), plus a new I-140 under EB-3 professional. The key: you keep your original EB-2 priority date on the EB-3 petition, effectively using whichever category has the better date each month. This strategy requires careful coordination with an immigration attorney and constant monitoring of the monthly DOS Visa Bulletin.

How Long Is the EB-3 Backlog for India?

CountryEB-3 Estimated WaitCurrent Priority Date (May 2026)
India10–15 years~Jan 2013
China5–8 years~Jan 2020
Philippines2–4 years~Jan 2023
Mexico1–3 years~Jan 2024
Rest of World0–1 yearsCurrent or 2025

Priority dates change monthly. Always verify at travel.state.gov before making decisions. Dates shown are approximate for illustration purposes.

What Are the EB-3 Filing Costs?

StageUSCIS/DOL FeeTypical Attorney Fee
PERM (ETA-9089)Free (DOL)$2,000–$5,000
I-140 (standard)$700$1,000–$2,500
I-140 (premium)$700 + $2,805Included in above
I-485 (with biometrics)$1,440$2,000–$4,000
EAD/AP comboIncluded in I-485Included

For Indian nationals on H-1B, your best first move is filing PERM as early as possible to lock in a priority date, then simultaneously evaluating EB-2 NIW self-petition (no PERM, no employer, potentially faster for India). Review the full H-1B to green card roadmap before deciding.
