Green Card Process

Advance Parole: Complete 2026 Guide

Traveling outside the US while your I-485 is pending without advance parole abandons your green card application. Here's what you must know.

What Is Advance Parole and Who Needs It?

Advance parole (AP) is a travel document issued by USCIS that allows certain non-immigrants to leave the US and return without a visa. It is primarily used by people with a pending I-485 Adjustment of Status application. Without advance parole, departing the US while your I-485 is pending is treated as an abandonment of that application, USCIS will deny your I-485 and you may be barred from re-entry depending on your prior status.

Per USCIS Form I-131 instructions, advance parole is requested on Form I-131 (Application for Travel Document). The fee is included in the I-485 filing fee when filed together. If filed separately after I-485 submission, the fee is $630.

Who Is Required to Get Advance Parole Before Traveling?

Can H-1B Holders Travel Without Advance Parole?

H-1B and L-1 visa holders with pending I-485 applications can travel without advance parole, they re-enter on their valid H or L visa stamp. However, this approach carries risk: if your H-1B is terminated while abroad, you cannot re-enter without advance parole or a new visa. Immigration attorneys almost universally recommend obtaining AP even if you have a valid H-1B visa, because it provides a guaranteed re-entry path if your employment situation changes unexpectedly.

Additionally, traveling on H-1B rather than AP "charges" a visa entry, meaning your I-94 will show H-1B status instead of "paroled," which can complicate some I-485 processing steps. Consult your attorney before traveling while I-485 is pending.

What Is the Combo EAD + AP Card?

When you file I-485 and I-131 together, USCIS issues a combo card that serves as both your Employment Authorization Document (EAD) and your Advance Parole travel document. The card is labeled "I-766" and shows "Allows Reentry to United States" on the front. This single card authorizes both work and travel. Processing time in 2026: approximately 6–10 months for the combo card. You can request a standalone EAD without AP, but the combo card is recommended for anyone planning to travel.

What Happens If You Travel Without Advance Parole?

Departing the US without AP while your I-485 is pending causes USCIS to deem your I-485 abandoned. You will receive a denial notice stating the application was abandoned due to departure. You would need to refile I-485 from scratch, paying all fees again, and importantly, your priority date is preserved, but you lose any time already accumulated toward your I-485 processing and any I-131 biometrics already completed. If your priority date retrogressed in the meantime, you may be unable to refile at all.

How Long Does Advance Parole Take in 2026?

USCIS advance parole processing in 2026 averages 6–9 months for I-131 filed standalone. When filed with I-485, the combo card typically arrives 6–10 months after filing. Expedite requests are available for humanitarian emergencies (family death, medical treatment), submit with supporting documentation. For work-related travel, expedite is rarely granted. Plan 90+ days before any non-emergency international travel after filing I-485. Monitor your case at USCIS case status online.
